Agent Accountability Programs

The Agent Accountability Programs are optional addenda to the listing agreement designed to hold the listing agent financially accountable to your agreed‑upon sale expectations. Two programs are available: the Top Dollar Guarantee and the 30‑Day Sale Guarantee. Only one program may be offered at a time, and the Top Dollar program is assumed unless a caller specifically references the 30‑Day program. Claire should only answer questions about the program the caller mentions.

Top Dollar Guarantee

The Top Dollar Agent Performance Guarantee is included as an addendum to the listing agreement and ties the agent’s commission to the sale results. If the final sales price (before concessions and closing costs) falls below a mutually agreed Top Dollar benchmark, the agent’s commission is reduced at closing. This guarantee is designed to ensure that your home sells for every dollar it’s worth.

How the Top Dollar credit works

Once you and the agent agree on a Top Dollar price, you receive a fixed credit for every full percentage point by which the gross sales price falls below that benchmark. The credit is deducted from the agent’s commission at closing and is capped based on the Top Dollar price range. If your home sells for less than 1 percent below the benchmark—even by a dollar—you still receive the minimum credit for one percent.

When determining the Top Dollar benchmark, the agent will provide a market analysis, discuss the property’s features with you, and mutually agree on a price. The Top Dollar benchmark may differ from the list price; the list price is a marketing tool and may be set higher or lower to attract the right buyers. Participation in this program is voluntary; you can choose a traditional listing without the guarantee if you prefer.

Participation requirements

  • Pre‑sale inspections: Order a general home and pest inspection within 10 days of signing, or provide reports from within the last three months. This helps ensure there are no material issues that could impact marketability.
  • Good‑faith cooperation: Make the home available and presentable for showings, provide required disclosures promptly, and avoid interfering with open houses or buyer interactions. Failure to act in good faith may result in cancellation of the addendum (as described in the contractual addendum).
  • Cancellation: You may cancel the guarantee or the listing agreement at any time, for any reason, with no fees or penalties.
  • Sale contingency: The guarantee applies only if the property sells with Sean Engmann as your listing agent. If the home does not sell or the agent is removed, the guarantee is void.

The combined total commission reduction under all programs is limited to $25,000; however, actual cap values may vary depending on the market and advertising piece. For example, some postcards and ads may reference a $10,000 guarantee while others offer up to $25,000. Claire should be aware that the cap referenced in the caller’s advertisement applies and should confirm the amount when discussing the program.

30‑Day Sale Guarantee

The 30‑Day Sale Guarantee (also called the “Top Dollar in 30 Days” program) combines the Top Dollar credit with a promise to get the home under contract within 30 days. This program may only be available in certain markets and is not offered at all times. The guarantee is incorporated into the listing agreement and specifies that if your home does not receive a qualifying offer at or above the agreed Top Dollar price within 30 days, the agent’s commission is reduced.

How the 30‑Day guarantee works

  • Guarantee term: The 30‑day clock starts when your home is listed as Active on the MLS. Days in “Coming Soon” or other off‑market statuses are excluded.
  • Commission reduction: If your home doesn’t receive a qualifying offer in 30 days, the agent reduces his commission by $150 per day starting on Day 31 until the property goes under contract. In addition, if the final sale price falls below the Top Dollar benchmark, you receive a $500 credit for each full percentage point below that price, with a $500 minimum even if the shortfall is less than 1 percent.
  • Maximum reduction: The combined reductions under this program are capped at $15,000.
  • Determining Top Dollar: As with the Top Dollar program, you and the agent jointly set the benchmark using a market analysis.
  • Risk‑free and cancellable: You may cancel the program or the listing agreement at any time, without penalty. The guarantee applies only if the property sells with Sean Engmann as your listing agent.

Steps in the 30‑Day program

  1. Quick phone call: Discuss goals and set up a property meeting.
  2. Meet at the property: Walk through together, review the market analysis, and advise on pricing and marketability.
  3. Set your price: Agree on a realistic Top Dollar benchmark or decide on a traditional listing.
  4. Game plan & launch: The agent delivers a custom marketing plan within about five business days and begins the sales process.

Quick & Free Exit Guarantee

Both programs include a Quick & Free Exit Guarantee: you may cancel the program or the entire listing agreement at any time, for any reason, without penalties or fees. This ensures you are never locked into an arrangement that doesn’t meet your needs.

Listing Packages

Sean offers several service packages to meet the needs of different sellers. The Base Package provides comprehensive support across every phase of the sale, while the Turnkey, Pro Prep, Elite Marketing and VIP packages add higher levels of preparation and marketing. Add‑on services are available for those who need additional project management.

Base Package

  1. Preparation
    • Coordination and assistance with all required paperwork.
    • Prepare a disclosure package for prospective buyers.
    • Recommendations for touch‑ups, updates and upgrades to the property to improve buyer perception.
    • Recommendations of vendors for work on the house.
    • Recommendations for inspectors to perform pre‑sale inspections if desired.
    • Recommendations on programs to assist with the cost of preparing the home for sale.
    • Guidance on decluttering, storage and cleaning services.
  2. Presentation
    • Consultation with a home stager or designer.
    • Recommendations on staging vendors.
    • A “show ready” checklist for occupied homes.
  3. Photography
    • Professional photography with a minimum of 25 curated photos.
    • A vertical social video of the property for social media.
    • A floorplan of the home.
  4. Pricing
    • A comparative market analysis evaluating the home’s value.
    • Recommendations on price strategy based on market conditions and the analysis.
    • Recommendations on any price adjustments based on activity.
  5. Promotion
    • Listing on the MLS.
    • Members‑only off‑market listing on MLS to test pricing or sell quickly.
    • Yard sign (if desired).
    • Professionally printed flyers distributed at open houses.
    • Targeted pay‑per‑click and social media ad campaigns.
    • Single property website with unique URL for campaigns.
    • Minimum of 250 Just Listed postcards mailed to the immediate area and targeted buyers.
    • Email marketing to Sean’s database and agent network.
    • Hosted open houses (if desired) during the first weekend.
  6. Process Management
    • Install a Supra lockbox on the property.
    • Control access and coordinate showings with buyer’s agents.
    • Respond to questions from prospective buyers and their agents.
    • Provide weekly market activity reports to the seller.
    • Receive and present all offers according to the seller’s instructions.
    • Evaluate and advise on offers; negotiate to achieve the best result.
    • Manage escrow: navigate contingencies, coordinate access for buyers and inspectors, manage disclosures and paperwork, negotiate issues during escrow, and coordinate signing and key transfer.
  7. Other Benefits
    • Free upgrade to the next service level if you also buy a home with Sean.

Turnkey Package

The Turnkey Package includes access to the Top Dollar or 30‑Day Guarantee programs and adds project management services. It encompasses everything in the Base Package and allows you to choose one of the following:

Pro Prep Package

  • Junk removal (one 14–16 ft truck).
  • Deep cleaning service of the house.
  • General home and pest inspections included.
  • Staging for two months included.

Elite Marketing Package

  • Twilight and aerial photography.
  • Property showcase video.
  • Matterport 3D tour.
  • Newspaper advertising.
  • Luxury real estate magazine advertising.
  • Geotargeted online advertising.

VIP Package

The VIP Package includes everything in the Turnkey Package and both the Pro Prep and Elite Marketing packages for a fully comprehensive selling solution.

Add‑ons

For sellers requiring additional support, project management services can be added to any package. Sean will act as the primary point of contact and manager for all vendors preparing the home for sale, assist with vendor selection, and provide updates on all aspects of the project.

  • Project Management Services: Additional 1 % fee for Turnkey and VIP packages, or $250 per hour for other clients.
